Cadmus Terms and Conditions

1. Scope of Agreement

These Terms and Conditions (“Terms”) govern the access and use of the Cadmus software platform, including the Jail Management System (JMS), Electronic Medical Records (EMR), and e-prescribing modules (collectively, the “Services”), provided by Autonomy Today, LLC (“Provider”). By accessing the Services, the Client and its Authorized Users agree to be bound by these Terms and any applicable Surescripts Network requirements.

2. Definitions

  • “Client” means the agency, facility, or medical staffing group entering into a Service Agreement with Provider.
  • “Prescriber End User” means an individual legally authorized to prescribe medication who is employed by or contracted with the Client.
  • “Surescripts Network” means the electronic network that facilitates the transmission of prescription information between prescribers, pharmacies, and payers.

3. E-Prescribing Services and Surescripts Certification

  • Certification Requirements: Access to the Surescripts Network is contingent upon the software maintaining its certification. Surescripts reserves the right to decertify the software or prohibit its use if it is found to be incompatible with network standards or patient safety protocols.
  • Identity Proofing: All Prescriber End Users must complete mandatory identity verification (Identity Proofing) and authentication to meet federal and industry standards before being granted access to e-prescribing functions.
  • Professional Judgment: The Services are a tool to assist in the transmission of information; they do not replace the professional judgment of the prescriber. Prescribers must verify medication history with the patient (inmate) whenever possible.

4. Workflow and Choice Mandates

Prescriber Choice of Medication: The Cadmus platform is designed to ensure that the Prescriber End User maintains absolute autonomy in selecting the appropriate medication. The system will not use automated prompts, advertising, or economic incentives to influence a prescribing decision toward a specific drug.

Patient Choice of Pharmacy: In accordance with Surescripts' neutrality requirements, the patient (or the legally authorized facility representative) has the right to choose the pharmacy to which the prescription is routed. The system provides access to all pharmacies currently connected to the Surescripts Network and does not preclude the use of any specific retail or mail-order pharmacy.

5. Prohibited Uses

Users shall not:

  • Use any means, including instant messaging or pop-up advertisements, to influence prescribing decisions through economic incentives.
  • Access the Surescripts Network from locations outside of the United States or its territories.
  • Decompile, reverse engineer, or attempt to derive the source code of the Services.

6. Data Accuracy and Disclaimers

Third-Party Data: Cadmus relies on external data sources (pharmacies, PBMs, and payers) for medication history and formulary information. Provider does not warrant that this information is complete or error-free.

Service Availability: While Provider aims for 99.9% uptime, access to the Surescripts Network depends on third-party connectivity. Provider is not liable for outages caused by the Surescripts Network or other external data sources.

7. Privacy and Security

  • HIPAA Compliance: Both parties shall comply with the Health Insurance Portability and Accountability Act (HIPAA). All Protected Health Information (PHI) must be handled in accordance with the Business Associate Agreement (BAA).
  • Credential Security: Prescriber End Users are responsible for maintaining the confidentiality of their unique identifiers and two-factor authentication (2FA) devices. Sharing credentials for Controlled Substance prescribing (EPCS) is strictly prohibited and may result in immediate termination of access.

8. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
